Legal Update: New York Investigates Destination-Trolling Lawyers

man pointing finger wearing suitA recent NBC news investigation shows the top ADA lawsuits—2,338 of them in New York alone—are initiated by a small number of nefarious lawyers targeting malls, colleges, wineries, galleries, and other destinations.

If you know someone who’s been hit by one of these drive-by lawsuits, you know how disruptive and costly it can be to resolve the issue. 

How can you protect yourself from drive-by lawsuits? And when will this trend end? 

A few bottom-fishing lawyers who prey on people with disabilities to make quick money ultimately cast shade on both well-intentioned lawyers and the disabled community making reasonable claims for equal access. Just like able-bodied customers, they have the right to a website they can navigate, a restaurant where there’s room for them to sit, a hotel that has an accessible bathroom and a ramp to be used for stairs. Don’t panic—and do educate yourself. The best approach for now: Watch the NBC news report and don’t panic. Instead, make yourself familiar with the Americans with Disabilities Act of 1990.

What the Bleeptastic Were You Thinking? Disabled Travelers Force Sacramento to Revise Evacuation Plans

It took six years to get Sacramento International Airport to agree to what one disabled airport user and many other disability advocates wanted—an emergency plan that included how to evacuate and assist people with disabilities in case of a disaster. A new protocol is finally in place (but don’t count on finding out what the bleeptastic transportation officials were thinking when they approved the original one). The case was settled.

Sacramento airport also wisely decided to give employees training on how to identify and assist disabled people. Finally, Sacramento’s Terminal B has a ‘Plan B’ that is a model of compliance with the Americans With Disabilities Act (ADA).

Visits to 700 Airport Websites Show Less Than 1 in 3 Pass Accessibility Tests

two men at computer work stations looking at their screens and typing Airport websites haven’t yet proven themselves in the accessibility arena, according to Accessible Travel Online (ATO). ATO reportedly spent several months visiting 700 airport websites. In most cases, it took at least a half hour per website to find the accessibility information. And even then, not all had the minimum criterium to be listed in ATO.

The minimum criterium:

  • information in English
  • detailed information on services, such as accessible toilets or parking
  • contact information for the Airport Services Desk
